This puppy/dog is sold as a pet only with a spay/neuter exhibit.  Pet quality simply refers to the puppy/dog being sold as a pet and companion only. Absolutely NO breeding rights are given with this contract. 

  1. BUYER agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care.  This includes keeping this puppy/dog parasite free and up to date with vaccinations, proper nutrition, and fresh water available at all times.  BUYER agrees to provide a safe environment for the puppy/dog, and never allow the puppy/dog to roam freely without proper fencing or supervision.

2) SELLER formally recommends BUYER purchases pet insurance for this puppy/dog. SELLER  guarantees this puppy/dog to be of sound health and temperament at the time of this sale.  A health record of all shots and worming will be provided by the seller. BUYER agrees to take this puppy/dog to a licensed veterinarian of their choice within 72 (SEVENTY TWO) hours of purchase for a physical examination, and agrees to send a copy of the  exam/ invoice via email to zoekinsella@gmail.com within 72 (SEVENTY TWO) hours of the exam.  If within the 72 (SEVENTY TWO) hour window after purchase should the puppy/dog be determined to be in ill health, the cause of which the Seller is at fault in the opinion of a licensed veterinarian and  Cornerstone Animal Hospital, the puppy/dog may, upon a signed written diagnosis from said licensed veterinarian, be returned within 72 (SEVENTY TWO) hours to the SELLER at the discretion of the SELLER to issue a refund of the purchase price or another healthy puppy from the litter. SELLER assumes absolutely no responsibility for fees associated with caring for the puppy/dog. SELLER also provides a 1 (ONE)  year genetic health guarantee limited to cover the death of the puppy/dog before 2 (TWO) years of age due to an undeniable congenital cause in the opinion of a licensed veterinarian and Cornerstone Animal Hospital accompanied by a written and signed cause of death per licensed veterinarian. It will be at the discretion of the SELLER  to provide a full refund of the purchase price or another puppy of the same or similar breed within a reasonable amount of time no longer than 3 (THREE) months.

3) If at any time the Buyer can no longer retain possession of this puppy/dog, the SELLER is to be notified and given the first right of refusal of resuming full ownership of the puppy/dog accompanied with all papers and medical records for no more than original purchase price.  Should any circumstances arise that affect the quality of life of the puppy/dog, the SELLER is to be informed so that they may participate in determining the future of the puppy/dog.

SELLER  reserves the right to approve/prohibit any transfer of this animal to a third party.  Under no circumstances will this puppy/dog be sold, leased, traded, listed on Craigslist or similar internet sites, or given away/sold to any pet shop, research laboratory, animal shelter or similar facility. 

4) BUYER agrees to contact KelleyDoodles immediately if any questions or concerns arise about the puppy/dog, such as housing, diet or health.  BUYER agrees to keep SELLER informed of any treatment as it occurs.

The preceding paragraphs contain conditions established by the SELLER to ensure the wellbeing of the puppy/dog.  The BUYER’s  agreements will continue for the duration of the puppy/dog’s life and the SELLER will have the right to enforce the agreements.

Spay/Neuter Exhibit To Sales Contract

Permanent ownership of this dog is contingent upon compliance with this Agreement.  BUYER must provide proof of the spay/neuter before the puppy/dog is 7 (SEVEN) months old by sending the SELLER  an invoice of the procedure from a licensed veterinarian via email to zoekinsella@gmail.com within 7 (SEVEN) days after the procedure.  

In the event the puppy/dog’s health does not allow this agreement to be honored the BUYER must be provide a statement to the SELLER via email to zoekinsella@gmail.com  from a licensed veterinarian that this dog is not yet in physical or emotional condition for the procedure.. Based upon the licensed veterinarian’s evaluation of this puppy/dog, the BUYER will contact the veterinarian and establish the earliest date  the procedure can be performed. BUYER will notify SELLER of the amended surgery date in writing via email to zoekinsella@gmail.com within 72 (SEVENTY TWO) hours of appointment. BUYER is still required to send proof of surgery in the form of an invoice of the procedure via email to zoekinsella@gmail.com within 7 (SEVEN) days after the surgery.

It is the responsibility of the BUYER, not the veterinarian, to ensure the SELLER  has received verification  the surgery has been performed. BUYER agrees to send  the vet's proof of neuter or invoice bill with the vet’s state license number and his/her signature for verification to SELLER  via email to zoekinsella@gmail.com.

BUYER: By signature below, BUYER agrees to have this dog spayed/neutered by 7 months, or up to 12 months with a written and signed licensed veterinarian recommendation. BUYER understands this spay/neuter agreement is an agreement this puppy/dog will not produce a litter of puppies either as purposely bred or by accidental breeding.

 Accidental breeding is considered neglect and the dog/bitch will be returned to  the SELLER within 1 (ONE) week of knowledge of dog/bitch’s pregnancy. All puppies born from any breeding, accidental or otherwise, will become the property of KelleyDoodles. 

BUYER agrees should the dog/puppy not be altered (spayed/neutered)  the BUYER  will pay SELLER  a penalty of $2,500.00  (TWO THOUSAND AND FIVE HUNDRED DOLLARS) in CASH by the date the puppy/dog turns 1 (ONE) year old or return the dog/puppy to SELLER  with no refund by the date the dog/puppy turns 1 (ONE) year old.  BUYER  agrees to never surrender the puppy/dog to a shelter or pound, but will return the puppy/dog to SELLER if BUYER can no longer care for the puppy/dog.

This SPAY/NEUTER EXHIBIT is the BUYER’S  responsibility to enforce if ownership rights of this puppy/dog are transferred to any party other than the SELLER.  BUYER assumes all responsibility and liability for puppy/dog unless ownership rights are transferred back to the SELLER..

~ STUD SERVICE AGREEMENT ~ 

This agreement is made and entered into on this date: __________. THE FOLLOWING CRITERION MUST BE MET BEFORE STUD DOG OWNER AGREES TO PROVIDE STUD SERVICES TO ABOVE BITCH: 

I. Must be 18 months of age.

II. Provide current copies or be able to verify current shot records and Rabies are current. 

III. Bitch presented for breeding must be clean, free from internal and external parasites, in good health, and inspected by a state licensed veterinarian within ten days of being presented for breeding. 

The following must be provided before the breeding will take place IF breeding is for live cover: 

  • Negative Brucellosis test within 30 days of breeding ONLY if a Natural breeding is being done, BUT HIGHLY recommended. 
(Current test documents are approved for the breeding)

  • Proof that Bitch is on a preventative worming program.

IV. I, Zoe Kelley, reserve the right to refuse stud services to anyone for any reason. 


General Terms of Agreement:

  • The stud service fee is $…………… plus any extra costs for breeding, examples include but are not limited to: AI, shipping semen, collecting semen, storing semen, or any other breeding related costs and all terms are as described below. 


  • All breedings are subject to a $………… non-refundable breeding fee. A breeding fee of $……… along with a signed stud contract will be due at time of breeding/shipment of semen. The fee is part of the total $……… fee. No breeding will take place until the breeding fee is paid and the check or Venmo transfer clears and the stud dog owner has a signed contract in hand. 


  • The owner of the bitch warrants that this bitch has not been exposed to any stud dog prior to her arrival and that she will be protected from such exposure after her return home. 



  • Because, the stud dog owner does not request a puppy back, the following applies: 


Bitch owner shall submit a signed stud contract and non-refundable $……. breeding fee for shipped semen prior to shipping semen or at the drop off of the bitch. Additional $….. breed fee is only due if using live cover, at pick-up. The final $……. breed payment is due once bitch is confirmed bred with puppies (can be from vet exam, sonogram, or x-ray confirmation.) Bitch owner and stud owner will provide a replacement breeding at the next heat cycle if breeding is unsuccessful.

The owner of the bitch hereby releases Zoe Kelley, or any other members of the stud dog’s household from any and all liabilities and/or damages such as illness, injury, or death to said bitch while in the possession of the stud dog owner. Under no circumstances is the stud dog owner responsible legally or financially for any illness/ injury/death, which may occur during or after this breeding or stay at the breeding kennel facility. 

CONFLICT RESOLUTION
 Mediation. Stud dog owner and Bitch owner agree to mediate any dispute or claim arising between them out of this Contract, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

This contract shall be deemed a legally binding contract and is under the jurisdiction of Habersham County in the state of Georgia.

 Guardian Home Contract 

This Guardian Home Agreement (“Contract”) is entered into between Zoe Kelley (KelleyDoodles, “Breeder”) and____________________________________________________________ (“Guardian”), whose address is ____________________________________________________________ __________________________________________________________________________

Breeder is a “Doodle” breeder that has developed a Guardian Home Program. This program allows the Breeder’s breeding FEMALE or STUD Guardian dogs to be fostered by loving forever homes while still maintaining status as a breeding dog for a contracted number of years. The Guardian seeks to provide a puppy with a loving forever home and also support the Breeder’s breeding needs through the Guardian Home Program. As such, Breeder agrees to deliver a puppy to Guardian and Guardian agrees to accept Guardian puppy and perform in accordance with this agreement. NOW THEREFORE, in consideration of the foregoing and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows: Breeder agrees to deliver to the Guardian ONE (1) female or male puppy of their before agreed upon breed (hereinafter designated as the “Guardian Dog”).

The agreed upon, non-refundable price that the Guardian will pay Breeder within ONE (1) day of signing this contract to enroll in the Breeder’s Guardian Home Program is TWO HUNDRED AND FIFTY DOLLARS ($250.00.) Accepted form of payment is cash. 

Signing of this contract and prior to delivery of FEMALE Guardian Dog, Guardian agrees to Guardian Dog remaining in the Guardian Home Program until FEMALE Guardian Dog is at least Six (6) years old or until having 6 successful litters. Breeder possesses the right to begin breeding all Guardian Dog’s at Breeder’s discretion. Both parties agree if Guardian Dog is female and pregnant or possibly pregnant upon Guardian Dog turning 6 years old, Breeder will retain full rights to Guardian Dog and her litter until Breeder is finished with final breeding. Signing of this contract and prior to delivery of STUD Guardian Dog, Guardian agrees to Guardian Dog remaining in the Guardian Home Program until Guardian Dog is at least Eight (8) years old or until breeder’s discretion. Breeder possesses the right to begin breeding Guardian Dog at Breeder’s discretion.

Both parties agree the Guardian Dog is the property of the Breeder until all terms of this Contract have been fulfilled. Likewise, any puppies born to a female Guardian Dog or any semen from a male Guardian Dog shall be the sole and separate property of the Breeder’s, and the Guardians shall have no ownership or possession rights to any use of the semen. Upon Satisfaction of this Contract, Breeder will transfer full ownership of Guardian Dog to Guardian after the contract has been fully satisfied. 

Breeder’s Responsibility during the time the Guardians have possession of the Guardian Dog, the Breeder shall provide the Guardians: 1. A puppy; Breeder’s pick of the litter for agreed upon gender. 2. Dietary guidelines and instructions for health care of the dog, including worming and vaccination information, heartworm medication, and guidance on all flea/tick preventative. 3. Have contact with Guardian Home and Guardian Dog. This can be through home visits or video conferences. 4. Pay for neuter/spay at the completion of contract or when Breeder deems the dog to not be needed or in a physical position to continue breeding. 6. Training on recognizing when a female comes in heat and approximate dates when to expect this. 8. Information on what to expect and how to care for a pregnant female. 9. Pay for all veterinary expenses related to breeding related costs only. (Hip x-rays, genetic testing, etc.) 10. If the Guardian Dog is FEMALE, Breeder will take possession of the dog at the appropriate time for breeding and the dog will remain with the Breeder for approximately One (1)  week, then be returned to the Guardians for its gestation period (pregnancy). The Breeder will take possession of the FEMALE dog up to 1 week (1) prior to her due date and she will remain with the Breeder until her puppies are whelped and weaned. (4+ weeks.) 11. If the Guardian Dog is a STUD, Breeder may take possession of the Guardian Dog upon providing Guardian ONE (1) day notice and Breeder will retain possession until stud needs are fulfilled. 12. Breeder will take the Guardian Dog back if for any reason the Guardian is no longer able to keep Guardian Dog until the end of the Contract. No monies will be exchanged in the event of Guardian returning Guardian Dog. 

Guardian’s Responsibility during the time the Guardian has possession of the dog; the Guardian shall: 1. Agree to vaccinate the Guardian dog in accordance with veterinary standards. (These costs will be covered by the Guardian Home.) These vaccinations include (for Guardian Dog): Distemper, Hepatitis, Parvovirus and at 3 months of age, Rabies. Guardian Dog (adult): Bordetella and Parainfluenza and regionally-recommended vaccinations. In addition, heartworm, flea and tick prevention should be covered by Guardian at all times. 2. At all times keep the Guardian Dog under close supervision and maintain them under physical control at all times for the duration of this Contract. The Guardian is responsible for any damage or injury inflicted by the Guardian Dog while in Guardian’s possession. The Guardian waives all rights of and claims for contribution and indemnification from Breeder and, with respect to any liability for damage or injury by the Guardian Dog, agrees to pay and assume all such liability and damage and to forever fully indemnify Breeder. 3. In the event of an accident or injury, Guardian assumes responsibility for all necessary veterinarian or hospital charges. In the event of illness, Guardian assumes responsibility for all necessary veterinarian or hospital charges. Guardian assumes responsibility for all routine veterinary costs including heartworm/flea control and wellness exams. 4. Breeder may show, photograph and have access to Guardian Dog for genetic testing, veterinarian visits and breeding. Guardian agrees to provide Breeder with such access upon request. 5. All health records, information regarding lineage and any document pertaining to Guardian Dog will be available to both Breeder and Guardian. 6. Agrees to report all non-routine veterinary visits to Breeder and deliver veterinary reports by either email or text/call to Breeder. Non-routine veterinary visits include all visits excluding vaccinations, teeth cleaning or wellness checks. 7. Shall communicate with Breeder each time Guardian Dog is in heat (female), beginning with the maiden heat and every heat thereafter for the duration of this Agreement. 8. Heat is defined as swelling of the vulva and the first day a spot of blood is noticed. Guardian must keep the Guardian Dog away from all in-tact male dogs while she is in heat to prevent accidental breeding (female). Guardian must keep STUD Guardian dog away from all females in heat (other than females breeder is working with) to keep from unwanted mating. 9. Shall notify Breeder in advance of any changes of address or phone number so Breeder may maintain an accurate and current listing. If Guardian moves out of state, they must get a consent in writing from Breeder. If not, Breeder has the right to remove the Guardian Dog from Guardian. If agreed in writing by Breeder, Guardian agrees to pay ALL travel expenses, hotel, gas or any other fees associated with transporting Guardian Dog to the new home and for future breeding/puppy transport. 10. Safely confine the Guardian Dog by using a traditional fence, or restraining the dog by using a leash whenever outside of the Guardian’s home/yard, especially during the female dog’s heat cycle and at all times with a STUD. Notwithstanding the above, once the dog has been trained to respond to voice commands off leash, retrieving for exercise is permitted. A female may not be left outside in the yard of a Guardian home, or any home, during her heat cycle (heats last for approximately 1.5 weeks, no more than 2 times a year). At this time a female may be left inside the home and away from all other dogs, or inside a secure crate or garage. 11. Provide adequate exercise for the dog on a daily basis. 12. Deliver Guardian Dog to Breeder or meet Breeder upon request with 24 hour notice for breeding purposes, testing, etc. 13. Keep the Guardian Dog well-groomed at all times. Utilize a professional groomer experienced with ‘doodle’ grooming when needed every few months as needed to keep the coat well maintained and healthy. 

Miscellaneous Removal of Guardian Dog - Breeders may remove Guardian Dog from the possession of Guardian for non-compliance of terms of this agreement, at which time the Contract shall terminate. Breeder agrees to consult with Guardian before permanently removing the dog from Guardian’s possession unless, in the judgement of the Breeder, the dog must be immediately removed from the possession of Guardian in order to protect the health, welfare and safety of the dog. If the dog does not need to be immediately removed from the Guardian’s possession, Breeder shall give Guardian a reasonable amount of time to comply with Breeder’s requirements for maintaining the health, welfare or safety of the dog before permanently removing the dog. Breeder will immediately remove a stud dog from the Guardian home should the Guardians hire out the stud or sell his semen without specific written permission from Breeder. If this were to occur, the Guardian would also pay the Breeder $3,000 which is the value of said stud service or semen.

Death of Guardian Dog, Breeder’s Possession - Should the dog die from natural or accidental causes, that are not considered negligence (non-compliance of using a leash or not keeping the yard fence in good repair and gate closed) this Contract shall terminate upon the happening of such occurrence and neither party shall have any further obligation to the other party. Death of Guardian Dog, Guardian’s Possession - Should the dog die from natural or accidental causes, that are not considered negligence (non-compliance of using a leash or not keeping the yard fence in good repair and gate closed) this Contract shall terminate upon the happening of such occurrence and neither party shall have any further obligation to the other party. Should the dog die from any unnatural causes (unless otherwise considered by Breeder) while remaining in the Guardian Home, the Guardian Family is responsible for the full price of the dog - $4,500 - and this Contract shall terminate upon the occurrence. Transfer of Ownership - When Breeder, in the sole and absolute discretion of Breeder, determines that the Guardian Dog shall no longer be used for breeding purposes, Breeder shall have the dog spayed/neutered and shall transfer full ownership of the dog to Guardian. This will occur after Six (6) successful litters or upon turning the age of Six, (6) for FEMALE Guardian. This will occur upon turning the age of at least Eight, (8) for MALE Guardian or until Breeder Discretion. Breeder will pay all costs associated with the spay/neuter in lieu of any payment for the dog up front or at transfer of ownership. Return of Guardian Dog - During the term of this Contract, Guardian may permanently return the Guardian dog to Breeder for any reason, at which time this Contract shall terminate. Accidental Breeding - Any accidental breeding must be reported to Breeder within 24 hours. Guardian acknowledges that Breeder operates a business, and any accidental breeding will cause significant losses to Breeder’s business and possible harm to the Guardian Dog. Guardian agrees to pay Breeder in liquidated damages a fee of $5,000.00. This fee is a genuine estimate of damages that will be incurred by such a breeding. The fee is reasonable in light of the harm that will be caused by the accidental breeding. All puppies from any accidental breeding are the Property of Breeder and will be placed in homes by Breeder. Any accidental breeding does not constitute a Contracted Litter and the Guardian will not be compensated; however, puppies from an accidental breeding must be cared for with the same diligence and respect as puppies from contracted litters in accordance with the terms of this Contract. Immediate Payment to Breeders - If, prior to transfer of ownership from Breeders to Guardians, the following occurrences happen, the Guardians agree to pay Breeder the sum of $5,000.00: 1-Guardian, independently and without the expressed written consent of Breeder, has the dog spayed or neutered. 2-Guardian intentionally causes injury to the dog that prevents the dog from breeding or intentionally or out of negligence causes death of the dog. 3-Guardian absconds with the dog, fails to advise Breeder of any change in Guardian’s address, or ceases communication with Breeder. Non-Transferable - This Contract shall not be transferred to another Breeder or Guardian in whole or in part without prior agreement. Image Rights: Any pictures the Breeder posts on Instagram or Facebook of the Buyers puppy may be copied by the Buyer and posted to their own social media accounts to share with family and friends (only). Any images shared by the Buyer through email, text or social media will be available for Breeder to copy and share on KelleyDoodles social media accounts. Breeder will tag Buyer in any posted images. Integration - This Contract and other Transaction Documents constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior agreements and understanding, both written and oral, between the Parties or any of them with respect to the subject matter hereof and thereof. Severability - If any provision of this Guardian Home Contract is determined by a Georgia Court to be unenforceable to any extent, the rest of that provision and of this Contract will remain enforceable to the fullest extent permitted by law. Binding Effect - Except as otherwise provided in this Contract, every covenant, term and provision of this Contract shall be binding upon and inure to the benefit of the parties, and their respective heirs, legatees, legal representatives, successors, transferees and assigns. Governing Law - The laws of the State of Georgia shall govern the validity of this Contract, without giving effect to its conflicts of law’s provisions, the construction of its terms, and the interpretation of the rights and duties of the parties hereto. Submission to Jurisdiction Waivers - the Breeder and Guardian agree that disputes arising out of or relating to this Contract shall be brought exclusively in the Courts of the State of Georgia. The Breeder and Guardian consent and submit to jurisdiction in such courts and waive all rights to trial by jury. Enforcement - In the event either party shall seek enforcement of any covenant, warranty or other term or provision of this Contract or seek to recover damages for the breach thereof, the party which prevails in such proceedings shall be entitled to recover reasonable attorney’s fees and expenses actually incurred by it in connection therewith. Amendments - Any amendments to this Contract may only be made in writing, signed by all the parties hereto.
